Article 4: Purchases

Customers have the option to purchase items from the Brothway range online. The purchase is completed when the customer receives a confirmation email from Brothway. The items will be delivered to the customer's home on the delivery date indicated in the confirmation email.

Customers have the following payment options:

  • Credit card
  • Bank card
  • Transfer (in this case, the item will be shipped as soon as payment is received. If payment is not received within 7 days, the order will be automatically cancelled.)

Article 5: Retention of title

The delivered items remain the exclusive property of Brothway until payment is made in full by the customer. The risk of loss or damage is transferred to the customer from the time of delivery. The customer agrees to inform any third parties of Brothway's retention of title, for example anyone attempting to seize the unpaid items.

Article 6: Sanctions for non-payment

Without prejudice to the exercise of other rights held by Brothway, in the event of non-payment or late payment, the customer is automatically and without notice liable for an interest of 10% per year on the unpaid amount from the date of default. In addition, the customer is automatically and without notice liable for a fixed compensation of 10% of the relevant amount, with a minimum of 50 euros per invoice. Without prejudice to the foregoing, Brothway reserves the right to take back the unpaid (fully or partially) items.

Article 7: Complaints

Any visible damage or qualitative deficiency of an item or other deficiency at the time of delivery must be reported immediately, on pain of the loss of any right.

Article 8: Warranty

a. Legal guarantee (for consumers only) Under the law of 21 December 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. Each item is subject to the legal guarantee from the date of purchase by (if applicable, delivery to) the first owner. Any commercial guarantee leaves these rights unaffected.

b. General To invoke the warranty, the customer must present the proof of purchase.

For items purchased online and delivered to the customer's home, the customer must first contact the Brothway customer service, after which the customer must return the item to Brothway at their own expense.
